PROFESSIONAL AND ETHICAL DILEMMAS IN LITIGATION

About the Program:
This seminar will consist of two panels, both of which will consider a series of hypothetical situations which may arise in litigation. Each hypothetical will address at least one ethical, professional or legal dilemma which a litigator may face while representing a client. A few examples: May you cross examine a hostile witness using notes from your prior phone call with the witness? (Or will that make you a witness in your case?) What are your obligations if you feel your client is lying? What are your rights/obligations if you feel opposing counsel is withholding evidence? When can you inform your clients if you are preparing to leave your law firm? How soon must you disclose to a client that you have made an error? May you draft an engagement agreement which limits the time in which your client can complain about the invoices? Can you threaten a bar complaint to obtain leverage in a civil suit?

The panels will consist of appellate judges (Supreme Court and Court of Appeals), trial court judges, lawyers from the Office of the General Counsel of the State Bar of Georgia, and experienced litigation attorneys. Attendees will be encouraged to participate in the discussions and add their insights.
